Patch testing (also known as a skin allergy test) is a full legal requirement under section 3 of the Health & Safety At Work Act 1974. It is enshrined in legislation and therefore any disclaimer signed by your client is not worth the paper it's written on. An injury resulting from a lash tint gone wrong can result in you having to pay your clients up to £12,000 in compensation and your insurance may not cover you without that patch/skin test which means its coming out of your pocket. Claims for hair dye gone wrong can be as much as £35,000 and with no win no fee solicitors always looking for business there will be no shortage of opportunities for them to make a claim as claims can be made up to 3 years following injury. If the client still refuses a skin test you should refuse the treatment.
